What protects your sun in Shellharbour — and what doesn't

This is the question we get asked in redeveloping streets and the one most installers change the subject on. The honest answer is that your panels have far less legal protection than people assume, and the useful response is a design decision rather than a legal one.

No right to sun

There is no general right to sunlight for a rooftop system in NSW. A neighbour building something lawful is not stopped because it shades your array.

Planning is different

Councils do consider overshadowing of living areas and private open space when assessing a development — but that is not a test about your roof, and complying development may not be assessed against it at all.

Design, don't litigate

Trees are the harder case

Buildings at least come with notices you can respond to. A neighbour's tree is protected by council controls, and you generally cannot prune or remove it because it shades your panels — doing so without approval can be costly. Where a tree is the problem the remedies are all on your side of the fence: array placement, and optimisers or microinverters so one shaded panel does not drag a whole string down.
